The following Terms of Use govern your use of the Parknjet.com website (the “Site”) and the use of Park n’ Jet’s mobile app (the “App”). Your access to (as well as the use of) the Site and the App are subject to these Terms of Use set forth below. Such terms as “Company”, “Park n’ Jet”, “PnJ”, “we”, “us”, or “our” shall refer to Parknjet.com and the App. Use of this Site and the App signifies that you have read, understand, and agree to be bound by the Terms of Use set forth herein and you are consenting to have your personal data transferred and processed in the United States and throughout the world.

Privacy Policy

Park n’ Jet, (the “Company”) appreciates the privacy of users of its website and App (“User” or “Users”), and the privacy of Users is very important to the Company. To that end, the purpose of this Privacy Policy (the “Policy”) is to assist Users to understand what information the Company collects on the website located at www.parknjet.com (the “Site”) and the App, and how the Company handles such information. This Privacy Policy applies to any use of the Site and App. We encourage you to read this Policy carefully before using the Site and App, services, and/or transacting business with the Company. If you have questions or concerns regarding this Policy, please contact the Company via email or mail using the contact information provided below. Further, this Policy may be updated from time to time. You should visit this page frequently to review any such updates. The Company expressly reserves the right to change the terms and conditions of the Policy from time to time as it sees fit. Such changes, modifications, additions, and/or deletions shall be effective immediately upon posting the revised Policy on the Site. User acknowledges and agrees that it is User’s responsibility to maintain a valid email address as a User, review this Policy periodically and to be aware of any new practices or modifications. User’s continued use of the Site or App after such modifications will constitute (a) an acknowledgment of the modified Policy, and (b) an agreement to abide and be bound by the modified Policy.

USE OF COMMUNICATION SERVICES

In order to enhance the Site/App and make it easier and more efficient to use, the Company may collect personally identifiable information. This refers to information that informs the Company about the specifics of the User. The Company may collect personal information for a User, such as first and last name, mailing address, e-mail address, and phone number, as well as other information. When you provide personal information through the Site or the App, the information may be sent to the Company’s servers located in the United States and other countries around the world.  The Company may collect and store any information that you enter into the Site/App or provide to the Company in some other manner. When User engages in certain activities on the Site/App, such as ordering a product or services, filling out a survey, or sending feedback, the Company may ask User to provide certain personal information by filling out and submitting an online form. It is completely optional for User to engage in these activities. If User elects to engage in these activities, however, the Company may ask that User provide certain personal information, such as first and last name, mailing address with zip code, email address, telephone and facsimile numbers, and other personal identifying information. When ordering products or services on the Site or App, User may be asked to provide a credit or debit card number. Depending upon the activity, some of the information asked of User to provide is identified as mandatory and some as voluntary. If User does not provide the mandatory data with respect to a particular activity, User will not be able to engage in that activity. User may elect not to provide the Company with certain voluntary information online; however, this may limit the extent to which User can utilize the Site or App. As is the case when Users visit most websites and Apps, to administer the Site, the User’s visit triggers the automatic logging of certain anonymous information about the User’s computer system such as the type of browser used, the server name and User’s internet protocol (“IP”) address. When User’s web browser or email application requests a web page or email from another computer using the Internet, it automatically gives that computer the “address” where it should send the information. This is called the computer’s “IP address.” This IP address does not contain any personally identifiable information. When User provides a credit or debit card number for the purchase of goods or services on the Site or App, the Company does not directly collect any credit or debit card information from User through the Site or App. Rather, all credit or debit card numbers and related information are processed through Vertex Payment Solutions, the Site’s chosen credit card processing service provider. The Site only collects enough information to process User’s order and to verify that payment has been made. In addition, the Company automatically gathers certain usage information, such as the number and frequency of visitors to the Site and App, length of stay, search requests, and other anonymous data. This data helps the Company determine usage levels on different parts of the Site/App and to conduct other internal research. The Company may aggregate such data and disclose it in an anonymous manner to third parties or as required by law. The Company may also monitor the use of passwords used in connection with the Site/App, and collect information regarding how passwords are used and by whom. The Company may also obtain both personal and non-personal information about Users from third party data gathering sources.  The Company may match this third-party collected information with the personal information that Users provide to the Company. The Company and its business partners, such as advertisers, may use various technologies to collect information from User’s computers/mobile devices and about their activities on the Site and App.  For example, the Company and its business partners may collect and store non-personally identifying information through technologies such as cookies, log files, clear gifs (also known as web beacons), and other technologies to help determine User viewing preferences for advertising and other purposes. The Site and App also employs cookies to recall information that User provides, and so that User can customize certain portions of the Site and App for User’s own purposes. In general, a “cookie” is a small piece of text data stored on User’s computer by a website, to give User’s computer a unique identity while the Site performs certain processes, such as calculating the number of unique visitors at a given time. Cookies may contain personal information such as email addresses, usernames, passwords, and/or completely anonymous information such as a randomly generated number. The cookies may be deleted once a User leaves a website, a section of a website, or closes the browser, or the cookies may remain so that the website remembers the user the next time the User visits that website. Most browsers allow Users to decline cookies automatically or to accept or decline each cookie individually. If User chooses to decline cookies from the Site, however, User may not be able to use some sections of the Website or it may hinder the Site’s functions.

SHARING AND DISCLOSURE OF USER INFORMATION

As a matter of policy, the Company will not sell, share, or rent information about User or User’s business that the Company collects on the Site and App in ways different from the following: (a) The Company may disclose such information it collects if User consents to such disclosure, including, but not limited to, when User indicates that User would like the Company to provide User or a related party with the Company products or services. (b) The Company may disclose such information to companies and individuals the Company employs or engages to perform services on its behalf, including, but not limited to, analyzing data, maintaining the Company servers, hosting the Site/App, enhancing the operation of the Site/App, filling orders, processing credit card payments, improving marketing and promotional efforts, statistically analyzing website and App’s use, improving product and service offerings, and customizing the Site’s/App’s content, layout, and services. This may include the release of User’s credit card information to the card-issuing bank to confirm payment for services purchased through the Site/App. These companies and individuals will have access to User’s information only to the extent necessary to perform their functions. (c) The Company may disclose information to the government or third parties when the Company, in its sole discretion, believes necessary or appropriate in connection with activity that is illegal or may expose the Company, or User, to liability or to protect the Company, other Users, or the public. (d) The Company may disclose information when required by law enforcement or judicial authorities, upon receipt of a court order or subpoena, or to cooperate with a law enforcement investigation. The Company reserves the right to report to law enforcement agencies any activities that the Company in good faith believes to be unlawful. (e) The Company may disclose and transfer such information to a third party that acquires all or substantially all of the Company’s business or operations. (f) The Company may collect, analyze and share information related to its sales with third parties. The Company shall NOT disclose User’s specific business information. (g) The Company may disclose such information as reasonably necessary to resolve disputes, troubleshoot problems and enforce the Company’s agreements with User, including Terms of Use and this Privacy Policy. The Company encourages its service partners to adopt and post privacy policies. However, the use of User personally identifiable information by the Company’s service partners is governed by the privacy policies of those service partners, and is not subject to the Company’s control.

SECURITY OF INFORMATION

At the Site/App, User can be reasonably assured that all personally identifiable information is secure, consistent with current industry standards. Such information is protected in several ways. Access by User to such information is available through an encrypted password and unique customer ID selected by User. User shall not divulge the password to anyone. In addition, User’s personally identifiable information resides on a secure server that only selected Company personnel and contractors have access to via password. The Company encrypts User’s personally identifiable information and thereby prevents unauthorized parties from viewing such information when it is transmitted to the Company. Users should know that due to the open communication nature of the internet the Company cannot guarantee that communication between the Company and User will be free from unauthorized access by third parties nor can the Company be responsible for information stolen from its servers or computer systems by information harvesting software which may have the ability to scrape data. The Company employs modern technology and safeguards to make reasonable efforts to prevent such practices. In order to most efficiently serve User, credit card transactions and the fulfillment of services to be provided are handled by established third party banking/processing agents. These institutions receive the information needed to verify and authorize User’s credit card or other payment information in order to process the User’s order. When the Company collects credit card information from User, it uses Secure Socket Layer (SSL) encryption, the industry standard for protecting privacy in web transactions. Unfortunately, no data transmission over the Internet or any wireless network can be guaranteed to be 100% secure. As a result, while the Company strives to protect User’s personally identifiable information, User acknowledges that (a) there are security and privacy limitations of the internet which are beyond the Company’s control; (b) the security, integrity and privacy of any and all information and data exchanged between User and the Company through the Site cannot be guaranteed; and (c) any such information and data may be viewed or tampered with in transit by a third party.

CHILDREN

The Company believes that it is especially important to protect children’s privacy online. The Company does not knowingly collect or use any personally identifiable information from children under the age of thirteen (13), and does not knowingly provide any personally identifiable information, regardless of its source, to any third party for any purpose whatsoever from visitors younger than thirteen (13) years old. No information should be submitted to or posted through the Site by visitors and/or Users younger than thirteen (13) years old.

CONTROL OF MARKETING INFORMATION

User controls what marketing information received from the Company by simply informing the Company if User wishes to opt out and not receive information from the Company. If User does not wish to receive information from the Company, User should check the particular communication or the corresponding sections of the Site for opt-out instructions.

WEBSITE / APP PROTECTION

User agrees not to use the Site or App: (1) in any unlawful manner or in any other manner that could damage, disable, overburden or impair the Site/App; (2) to use automated scripts to collect information from or otherwise interact with the Site/App; (3) to upload, post, transmit, share, store or otherwise make available any content on the Site/App without our consent; (4) to upload, post, transmit, share or otherwise make available any unsolicited or unauthorized advertising, solicitations, promotional materials, “junk mail,” “spam,” “chain letters,” “pyramid schemes,” or any other form of solicitation; (5) to provide material support or resources (or to conceal or disguise the nature, location, source, or ownership of material support or resources) to any organization(s) pursuant to Section 219 of the Immigration and Nationality Act.

CHANGING USER INFORMATION

User may review, update, correct or change the information User provides to the Site/App at any time by accessing User’s account online or by contacting the Company directly.

The Company attempts to maintain the accuracy of the content of its Site and App. Any errors or omissions should be reported to parknjetparking@gmail.com. The Company makes no claims, promises, or guarantees about the absolute accuracy, completeness, or adequacy of the contents of the Site and expressly disclaims liability for errors and omissions in the contents. No warranty of any kind, implied or expressed, or statutory, including but not limited to the warranties of non-infringement of third party rights, title, merchantability, fitness for a particular purpose, and freedom from computer virus, is given with respect to the contents of this Site/App or its hyperlinks to other internet resources.

Terms of Use

Park n’ Jet reserves the right to change these Terms of Use at its discretion any time without notice. These Terms of Use shall be governed by the laws of the State of Utah, without giving effect to any principles of conflicts of law. If any provision hereof shall be unlawful, void or for any reason unenforceable, then that provision shall be deemed severable from these Terms and Conditions of Use, and shall not affect the validity and enforceability of any remaining provisions hereof. The rights to use this Site and App granted to you hereunder are personal to you and are not subject to transfer or assignment. Any claim relating to this Site and App or its use shall be subject to the exclusive jurisdiction of the federal and state courts located in Utah, and by your use of this Site and App you submit yourself to the personal jurisdiction of such courts. Park n’ Jet may change or modify these Terms of Use at any time, and such changes or modifications will come into effect immediately upon posting to the Site. The date at the top of this page indicates the date when the Terms of Use were last modified. Your continued use of the Site or App after any change or modification constitutes your acceptance of the new Terms of Use. If you do not agree to abide by these or any future versions of the Terms of Use, do not use or access the Site or App. It is your responsibility to regularly check the Site to determine if there have been changes to these Terms of Use. The Site/App is available only to users who can form legally binding contracts under applicable law. The Site/App and the materials located on or through the Site and App are provided for informational purposes only. You agree and acknowledge that we make no representation or warranty as to the accuracy of any information on the Site/App or linked to the Site. Any registration by, use of or access to the Website/App by anyone under eighteen (18) is unauthorized, unlicensed and in violation of these Terms of Use. By using the Website/App, you represent and warrant that you are eighteen (18) years of age or older and that you are fully able to enter into and abide by all of the terms and conditions of these Terms of Use. Your membership may be terminated and any profiles you have created may be deleted if we believe you are less than eighteen (18) years of age. Park n’ Jet operates one parking facility located at 2200 West North Temple, Salt Lake City, UT 84116; referred to as “Mountain Lot”. The North Temple Lot parking services include: Self Park Uncovered Standard, Priority, and Covered parking. In addition to parking, Car care services are also offered at this location (i.e. mechanical and detail services). Park n’ Jet provides directional signs at our facility to direct customers to specific parking service areas. Parking services are priced based on a 24-hour period; additional charges apply for the time exceeding the initial 24-hour period. Rates are subject to change and quotes are valid at the time of booking only. The number of “days” or 24-hour periods charged when you pre-book is calculated based on the times you select upon booking. Note, if your actual entry and exit time changes from that specified in your booking and exceeds the amount of time booked, you will be liable for any additional charges. Once the first 24-hour period has elapsed, you are charged $2.00 for each additional hour until the parking service daily rate is reached. Any differences between the booking price and the actual price must be settled upon exit. In July 2012, the Salt Lake City Council adopted ordinance No. 48 of 2012 amending City code section 5.04.200 Parking Service Businesses License Tax. The purpose of the ordinance was to enact a tax of $1.00 per paying vehicle levied for each day the vehicle is parked at the Parking Service Business (Park n’ Jet). Park n’ Jet passes this tax directly to the customer at a rate of $1.00 per day. Park n’ Jet also charges a fee of $0.75 per day, relating to airport access fees and fuel surcharges. Combined these taxes and fees total $1.75 per day and are referred to as “taxes and fees”. At our North Temple Lot, customers are greeted upon entry, select their parking preference (Standard, Priority, or Covered), and are instructed where to park. Customers are given two tickets; (1) the “Visor Copy” to be placed on dashboard face up, and (2) customer claim ticket copy retained by the customer. At exit, please present customer claim ticket. Customers are encouraged to download the Park n’ Jet mobile App for expedited entrance and exit. If you are using the Park n’ Jet mobile App, you will not need to pull an entry ticket, instead use the bar code on your App for entrance and exit. Park n’ Jet booth attendants will be available for assistance. When you park your vehicle, please ensure that your car is locked with the windows closed. Please apply emergency brake and engage steering lock where applicable. Park n’ Jet is not responsible for loss or damage to your vehicle by weather, fire, theft, breakage, collision, or for articles left in your car. Vehicles are parked at owner’s risk. Park n’ Jet and its employees do not accept any valuables or other articles for safe custody. Customers must drive carefully and responsibly in our facility and maintain speeds below 7.5 MPH. Customers are asked to wait by their vehicle for pick up for added safety. Please ensure that children are properly supervised while at our facility and remain by your vehicle for pick up and at drop off. You must comply with all directional signage, speed limit (7.5 MPH) and other instructions when in the facility.

Shuttle Service

Please allow 15 -20 minutes to check in, park your car, board the shuttle, and arrive at the airport terminal. Allow ample time to locate a space, retrieve your luggage and other items from your car, lock your car, and for other passengers to board the shuttle. Note, the airport recommends arriving at least 1 hour prior to flight departure. To make your flight, plan to arrive at Park’n JET at least 1 hour and 15 minutes before your scheduled flight departure time. Times may vary depending on weather conditions or due to additional security measures conducted by airport security. Upon exiting the shuttle at the terminal, please ensure that you point out all your luggage to the driver as he or she unloads it. Park n’ Jet does not accept responsibility if you miss your flight or your airline check-in window has closed due failure to allow for sufficient time to check in at our facility and arrive at the airport terminal. We strive to circulate shuttles through the airport every 5 – 10 minutes. After leaving the lot, our shuttles will get to the airport in 5 – 8 minutes. Once you call Park’n JET after obtaining your baggage, a shuttle is dispatched immediately if it is not already in route. Average wait times are approximately 8 – 12 minutes. To track our shuttles, please download our Park n’ Jet mobile App. Park’n JET provides handicap accessible shuttle service for passengers requiring wheelchair accessible transportation to and from the airport. Please contact Park’n JET 24 to 48 hours in advance to arrange for wheelchair accessible service. Park n’ Jet does not accept liability for increased travel times from our facility to the airport terminal due to adverse weather conditions, mechanical issues, traffic, accidents, or roadwork.  

Reservations

Parking reservations are available through the Park n’ Jet website (www.parknjet.com) or the Park n’ Jet mobile App. Reservations are not required, but highly encouraged to simplify your travel. During peak travel times such as UEA Weekend, Thanksgiving, and Christmas, we recommend making reservations in advance. In consideration of your reservation payment, Park n’ Jet agrees to make available to you one (1) vehicle parking space at facility beginning at the Check-In Date/Time which you designated. Park n’ Jet accepts American Express, Discover, MasterCard, and Visa as payment. When users make reservations through our Site or App, users prepay in advance for parking based on the departure and return dates and times entered on the Site or App when making the reservation. This amount covers parking fees provided by Park n’ Jet except those services for which you contract directly with Park n’ Jet (e.g. car care services). The reservation rate cannot be combined with any other discounts or offers. In consideration of your advance payment to Park n’ Jet for parking in the amount indicated on the Site/App, Park n’ Jet hereby agrees to provide one parking space per reservation at Park n’ Jet’s facility, commencing at the check-in time designated on the Site/App when you booked your reservation. By prepaying your parking in advance, you hereby authorize and direct Park n’ Jet to process a charge for parking to the credit card in your name which you designated on the Site/App when booking your reservation, and you hereby represent to Park n’ Jet that you are authorized to use such credit card for such purpose. You acknowledge and agree that if your vehicle is left at Park n’ Jet for more than forty-five (45) days after the actual check-in time, then such vehicle shall be deemed “abandoned” and such vehicle and its contents may be impounded at your expense and sold for expenses and storage fees. This policy does not apply to monthly parkers as well as to customers that have given Park n’ Jet notice in advance of their intent to leave their car at our lot for longer than forty-five (45) days. Further, in cases where you make a reservation using a third-party, you agree to abide by the terms or conditions of purchase imposed by such third party parking vendor, including without limitation, payment of all amounts when due and compliance with all rules and restrictions imposed by such vendor. Users are responsible for all charges, fees, duties, taxes, and assessments arising out of the use of the Site.

REFUND POLICY

If you wish to cancel your parking reservation, you must provide us with at least 24 hours’ notice in advance of the departure date/time stated on the receipt in order to receive a full refund amounts previously paid. To cancel your reservation, please call (801) 596-7275 or email parknjetparking@gmail.com. Park n’ Jet will issue a credit to the credit card that you used to make your reservation. In the unlikely event that you arrive at the Facility at your designated check-in time and no parking space is available, any pre-paid reservation fees will be refunded in full. For your inconvenience, Park n’ Jet provide you with a voucher for one free week of parking.

MVP REWARDS

Park n’ Jet offers a parking loyalty rewards program referred to as MVP Rewards. For every $1 you spend, you will receive one loyalty reward point. Points may be redeemed for various rewards ranging from free parking to various detail services. Park n’ Jet has designed a flexible rewards program that allows you to redeem points at your leisure with no restrictions or black-out dates. As an MVP Rewards member, you will have online access to your account at www.parknjet.com or using Park n’ Jet’s mobile App allowing you to view your parking history, determine total point accumulation, among other benefits. To start earning points under our program, you must join MVP Rewards. Once you become a member of MVP Rewards, you will be issued a MVP Card and will be given online account access. For ease of use, we encourage all MVP Rewards members to download the Park n’ Jet mobile App. Note, the mobile App can be used in place of the MVP Card for express check-in and check-out. Every time you park with us, present your MVP card or mobile App bar code upon entrance and exit to accrue points. When you have earned 200 or more points, you may redeem them at your next visit. Alternatively, you may continue to accumulate points to redeem a reward of greater value. When you’re ready to redeem your reward points, simply hand your MVP card to the cashier upon exit or XXXXXXXX (ask netPark about how the App can be used to redeem points) and choose your reward. Points cannot be redeemed for partial rewards. Points can be redeemed as follows: 120 points = One Day Standard Parking (Open) 190 points = One Day Covered Parking 400 points = Exterior Hand Wax 450 points = Express Combo (In/Out Wash) 1,900 points = Complete Detail Park n’ Jet’s MVP Rewards Program is subject to change without notification. Cards cannot be combined. Points earned through this program have no cash value. Points earned have no expiration date, unless the rewards program is terminated. Park n’ Jet’s MVP Rewards points may not be combined with other coupons, ads, or special promotions. Membership in Park ‘n JET’s MVP Rewards Program may be revoked at any time. Park n’ Jet reserves the right to alter, limit or modify program rules, rewards, and reward levels, or to terminate its MVP Rewards Program or membership at any time. Usage of the MVP card and/or redemption of points accumulated acknowledges your acceptance of these Terms and Conditions. To accumulate rewards points, it is the customer’s responsibility to present their card or APP to the booth attendant or at the automated exit machine when paying for parking. This program is not valid for use by Park n’ Jet employees. Park n’ Jet will not release your name to any list, or service and information obtained through the MVP Rewards Program will be held in the strictest of confidence.

OTHER

Rates, coupons, and taxes/fees posted on Park n’ Jet’s Site/App are subject to change at any time. Park ‘n JET reserves the right to decline or charge a surcharge on certain over-sized or modified vehicles. We reserve the right to move vehicles within the lot as deemed necessary. Park n’ Jet assumes no responsibility for articles left in the vehicle or damage by fire, theft, mechanical defects, windshield cracks, or damage in any case except through our own negligence. Vehicles are parked at owners’ risk. Customer’s rights to filing a claim are contingent upon the customer completing an inspection of his/her vehicle upon dropping and picking up his/her vehicle. In order to prevent false claims, we ask that you carefully inspect your car upon drop off. In case of damage claim, loss, or complaint, customer is responsible for filing the damage claim form, making sure that our staff has taken pictures of the damage before the vehicle leaves the parking lot if not so made, any such claim is waived by the customer. Should Park n’ Jet agree to make repairs to customers’ vehicles at its expense, Park n’ Jet shall have the right to choose the business, place, and/or person to make any agreed upon repairs. Court actions by the customer for any claim must be filed within thirty (30) days from the date of claim, in a court of jurisdiction where claimed loss occurred. We are not responsible for drained batteries or any damage due to the weather conditions such as any interior or exterior damage due to Sun, freezing locks, doors, wipers or any other effect on car due to cold, wind, and etc. Further, you acknowledge and agree that Park n’ Jet has the right to refuse to display any content posted by you on the Site, including, reviews, ratings and user profile information such as photos.

DISCLAIMER OF WARRANTY

USE OF THIS SITE/APP IS AT YOUR SOLE RISK. ALL CONTENT, DOCUMENTATION, MATERIALS, INFORMATION, PRODUCTS, SOFTWARE, PROGRAMS, AND SERVICES ARE PROVIDED “AS IS,” WITH NO WARRANTIES OR GUARANTEES WHATSOEVER. PARK’N JET EXPRESSLY DISCLAIMS TO THE FULLEST EXTENT PERMITTED BY LAW ALL EXPRESS, IMPLIED, STATUTORY, AND OTHER WARRANTIES, GUARANTEES, OR REPRESENTATIONS, INCLUDING, WITHOUT LIMITATION, THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT OF PROPRIETARY AND INTELLECTUAL PROPERTY RIGHTS. WITHOUT LIMITATION, PARK’N JET MAKES NO WARRANTY OR GUARANTEE THAT THIS WEBSITE/APP OR ANY CONTENT WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.
